These general terms and conditions of business (hereinafter: "general terms and conditions") govern the conditions for providing psychological counseling and coaching services by Sanela Dmitrović, Psychological Counseling and Coaching Services (hereinafter: "the provider").

These general terms and conditions apply to all clients (hereinafter: "client") who use the provider's services, regardless of whether the services are ordered via the website, email, phone, or direct contact.

By ordering services or using the website, the client confirms that they are familiar with these general terms and conditions and fully accepts them.

Key terms used in these general terms and conditions:

  • Client – a natural person who orders or uses the provider's services.
  • Services – all forms of psychological counseling, coaching, workshops, and other programs offered by the provider.

Psychological Counseling and Coaching Services

The provider offers the following services as part of her activities:

  • individual psychological counseling – support for individuals in coping with personal challenges, emotional distress, life changes, and interpersonal relationships;
  • coaching (personal and professional) – a structured process aimed at achieving personal or professional goals, developing competencies, and strengthening potential;
  • online counseling – providing remote services via video conference or phone;
  • workshops and group programs – thematic group meetings and educational programs (if available in the provider's current offer).

Important notice: The provider's services do not constitute psychotherapy, psychiatric treatment, or other medical care. The services are not a substitute for medical assistance or treatment of mental illnesses. In case of serious mental health issues or crisis situations, the provider refers the client to an appropriate specialist.

By using the website, the visitor or client agrees to use the website in accordance with these general terms and conditions, applicable law, and generally accepted standards of online conduct. 4. Contract Formation and Service Ordering

The contractual relationship between the provider and the client is established when the client successfully books and confirms an appointment for a session or service.

Services can be ordered in the following ways:

  • via the contact form on the website www.saneladmitrovic.com;
  • by phone or other direct contact.

By confirming the reservation, the client confirms that they are familiar with these general terms and conditions, understand them, and fully accept them.

The provider reserves the right to refuse an order for services or the provision of services without stating a reason, especially in cases where they deem the services unsuitable for the client's needs or when other justified reasons exist.

Limitation of Liability

The prices of individual services are published on the provider's website or communicated to the client before the service is performed. All prices are expressed in euros (EUR).

Payment for services is possible in the following ways:

  • by bank transfer to the provider's transaction account;
  • by another payment method agreed with the provider.

Payment is made before or at the time of the session, unless otherwise agreed with the provider. In case of late payment, the provider reserves the right to charge statutory default interest.

The provider issues an invoice for the services rendered in electronic form, which is sent to the client's email address. The invoice is issued in accordance with the valid legislation of the Republic of Slovenia.

If the provider is not liable for VAT, VAT will not be charged on the invoice, in accordance with the provisions of the Value Added Tax Act (ZDDV-1). In case of a change in the provider's tax status, prices will be adjusted accordingly.

Changes to Terms

The client may cancel or reschedule an agreed session appointment without additional costs if they inform the provider at least 24 hours before the agreed appointment.

In case of late cancellation (less than 24 hours before the agreed appointment) or unexcused non-attendance (i.e., "no-show"), the client will be charged the full price of the agreed session.

The provider may cancel or reschedule an agreed appointment for justified reasons, in which case they will inform the client in a timely manner and offer an alternative appointment.

Force Majeure: In the event of force majeure circumstances (natural disasters, epidemics, telecommunication network outages, and similar) that prevent the session from taking place, neither party shall be liable for non-fulfillment of obligations. In such a case, the appointment will be rescheduled to the first available date.

Governing Law

By ordering services, the client undertakes to:

  • provided true, accurate, and complete data necessary for the provision of services;
  • actively and honestly participated in the counseling or coaching process;
  • was aware that the provider's services do not replace medical, psychiatric, or psychotherapeutic treatment;
  • inform the provider in a timely manner about any health conditions, diagnoses, or other circumstances that could affect the course of the services;
  • arrive at agreed appointments on time; in case of delay, the session duration will not be extended;
  • in the case of group sessions, respect the confidentiality of other participants and not disclose personal information learned during the group session.

8. Provider's Obligations

The provider undertakes to:

  • perform services professionally, diligently, and in accordance with the ethical standards of the profession;
  • protect the confidentiality of all information obtained within the scope of services;
  • ensure her continuous professional development and education;
  • inform the client before the start of cooperation about the nature, scope, and limitations of the services;
  • refer the client, if necessary, to other appropriate specialists (doctor, psychiatrist, psychotherapist) when she determines that the client's needs exceed the scope of her services;
  • act in accordance with applicable ethical codes and standards in the field of psychological counseling and coaching.

9. Confidentiality and Personal Data Protection

All information provided by the client to the provider during sessions or other collaborations is strictly confidential. The provider undertakes not to disclose confidential information to third parties, except in the following cases:

  • when required by applicable law or an order from a competent authority;
  • when there is an immediate danger to the life or health of the client or a third party;
  • when the client provides explicit written consent for the disclosure of specific information.

The provider processes the client's personal data in accordance with Regulation (EU) 2016/679 (General Data Protection Regulation – GDPR) and the Personal Data Protection Act (ZVOP-2).

10. Intellectual Property

All materials prepared or provided by the provider to the client within the scope of services (including documents, worksheets, exercises, presentations, audio and video recordings, and other copyrighted works) are the intellectual property of the provider and are protected in accordance with the Copyright and Related Rights Act (ZASP). The same applies to all content published on the provider's website (texts, photographs, graphic elements, video recordings, logos, and other content), as further defined in Chapter 3 of these general terms and conditions.

The client may not reproduce, distribute, publicly communicate, adapt, or use the material for commercial purposes without the provider's prior written consent.

Recording of sessions (audio, visual, or audio-visual) without the provider's prior written consent is expressly prohibited.

11. Limitation of Liability

The provider's services are supportive in nature and do not constitute medical, psychiatric, or psychotherapeutic treatment. The provider does not guarantee the achievement of specific results, as the success of the process also depends on the client's active participation and external factors.

The client is solely responsible for their decisions and actions taken based on or in connection with the provider's services.

The provider is not liable for:

  • indirect or consequential damages, including lost profits, loss of data, or emotional distress;
  • damage resulting from incomplete or inaccurate information provided by the client;
  • damage resulting from the client's actions contrary to the provider's recommendations.

In any event, the provider's total liability is limited to the amount paid by the client for the specific service in connection with which the damage occurred.

12. Termination of Contractual Relationship

Either contracting party may terminate the contractual relationship by providing written notice to the other party.

The provider may terminate the contractual relationship without prior notice in the following cases:

  • if the client's conduct violates these general terms and conditions;
  • if the client exhibits inappropriate, offensive, or threatening behavior;
  • if the provider determines that continued provision of services is not in the client's best interest.

Obligations incurred prior to the termination of the contractual relationship (especially the obligation to pay for services already rendered) shall remain in effect even after termination.

In the event of termination of the contractual relationship where services have been paid for in advance but not yet rendered, the client is entitled to a refund of a proportionate share of the amount paid for unrendered services, unless the termination occurred due to the client's breach of these general terms and conditions.

13. Dispute Resolution

The contracting parties shall endeavor to resolve any disputes arising from or related to the contractual relationship amicably, through mutual agreement.

If an amicable resolution is not possible, the materially and locally competent court in Ljubljana, Republic of Slovenia, shall have jurisdiction over disputes.

14. Applicable Law

For the interpretation and application of these general terms and conditions, and for all relations between the provider and the client not explicitly regulated by these general terms and conditions, the law of the Republic of Slovenia shall apply.

15. Final Provisions

The provider reserves the right to amend or supplement these general terms and conditions. The amended terms and conditions will be published on the website www.sanela.dmitrovic.com and will become effective on the date of publication or on the date specified therein.

By continuing to use the services after the publication of the amended terms and conditions, the client expresses consent to the amended terms. The provider will inform clients of significant changes in an appropriate manner.

If any provision of these general terms and conditions is found to be invalid, illegal, or unenforceable, this shall not affect the validity and enforceability of the remaining provisions (severability clause). In such a case, the invalid provision shall be replaced by a valid provision that best reflects the spirit and purpose of the original provision.

The service provider assumes no responsibility for the results of the user's progress, as the services are individualized and dependent on the user's participation.

The user has the option to cancel an appointment free of charge up to 24 hours before the scheduled time. For cancellations less than 24 hours before the appointment, the full service fee will be charged, except in exceptional cases at the provider's discretion.

Due to the nature of the services, refunds are not possible after counseling or coaching has been rendered.

Content of Educational Materials

All educational materials and content on the website www.sanela.dmitrovic.com are intended exclusively for education and personal growth support. The information in the materials is not a substitute for personal psychological treatment.

Intellectual Property Rights

All materials (video, audio materials, texts, graphic elements) are protected by copyright and are the property of the provider. Copying, sharing, or public distribution without the provider's written permission is not allowed.
